Boise and company agreed to work with SCO on the IBM case on contingency. If Boies wins, he gets a goodly cut of the loot, if he loses he gets nothing. Some expenses may be being paid by SCO out of pocket as well. The agreement on a cut of a sell out is just some insurance for Boies, I think. If the company sells out to some suddenly motivated buyer, say IBM, Boies still gets a goodly cut of the loot. If the company is not sold, he still has to win the case.
