"Do software patents really inspire and create innovation?"
NO. It's allowing large businesses to oppress and shut down small businesses. The company with the largest patent portfolio can simply find a patent they have, which is fairly easy, since the simplest and stupidest things are being patented, and force anybody to pay outrageous royalty fees.
Where is the innovation in that? Answer: None. The patent system wasn't designed for the software industry, and now it's hurting it.
