Right or Wrong, Real loses
If this goes to court and Apple wins, Real's customer lose.

If it doesn't and Apple changes the iPod software to kill the Real hacks, Real's customers lose.

Who cares who is right? Either way, IMO, if you are a Real customer, you lose.
