Yes this tired answer again...
see, you are still in this frame of mind that what American courts and laws dictate the rest of the world will follow. This is where you are wrong. So what, Linux stumbles in the US, to bad for America. But it will continue to grow in other nations, remember them? Yeah that's right the other 181+ nations that comprise the world population.

Again American arrogance prevails. Take Linux distrobutions to court, the American ones that is. Please, let the other nations continue to pull ahead of the United States, like many have or currently are in other areas, such as manufacturing, electronics, technology, medical research.

The bottom line is that I will still be able to get my Linux distrobution from Germany, Noroway, France, China, Korea... see the problem with this whole deal? No matter what, Microsoft cannot ever beat Linux. It's not a US company, it as a concept and implementation is not an American asset beholded to our laws and patents.

You might as well accept the inevitable. Linux will continue to grow.
