Come on, I highly doubt anyone is going to do jail time over this. Copyright infringement is 99% a civil matter, and will be dealt with in a civil court, where jail time is not an available "punishment" option if you will. The RIAA isn't stupid enough to try and bring a criminal charge against the infringers, because not only would they have to prove intent (which would be almost impossible to do in the case of p2p downloading), but with the given state of the legal system in regard to computer records, etc, probably 99% of the "evidence" they have against the infringers isn't admissible in a criminal court. They stick to civil courts because the burdon of proof and the rules of the game are much less stringent on the prosecution, and at least in the US, unlike with a criminal court, they don't have to prove that you are guilty BEYOND A RESONABLE DOUBT, they just need to present a case that a judge or jury will by into.

I'm not going to say that p2p'ers are right in their ways, but I would love to actually see one of them not settle with the RIAA and fight it out in court. There is no way a jury (maybe a judge, but not a jury) in a civil court would find against a defendent in this matter, and with a good solid defeat on their record, more of these pirates would stop settling and fight it out, and eventually it would become too fruitless to even try and bring civil charges against downloaders. Then the RIAA can get back to their core business, raping artists and consumers alike.
