well,
as i've said before.. as long as the industry actually has a valid case of harm caused by these pirates, go ahead file the suit, get their identity and try to prove your case.
if on the ther hand, they are simply phishing for names and planning on threatening people who've done them no mharm with law suits in order to extort settlements out of them... who's the real criminal?
