- What File Sharers Fail to Realize

Is that they for the most part as participants cannot hope to have a thing called 'copyright,exhibited with a c),and registered with the library of congress for everything they wish to share. What file sharing does with most of these participants is actualy a 'fair-use violation. Traditionaly the right to record (as opposed to copy)is left to the person of use for purchased products,and local television broadcasts via video tape,or esthetically somthing dubbed from a radio broadcast.
This is what most of these files are consistent of in wich what MPAA,and RIAA sees as 'copyright violations. In my view since there is no point of law that recognizes the 'person of use for copyrighted works,there is no way to defend of 'fair-use when these works are taken and given to the general public from your utility of home recording.
While most are not a blatant copy and pass to the general public they are not intended to deprive the copyright holders of the manufactured part for the copyright effect. They are merely using the facilitation of 'file-sharing for the 'performance of them. This is the difference of what RIAA,and MPAA uses in pretense of 'piracy.
The difference as well from copy,and record are just as questionable. Depending on who may be looking on to the question. But since most of the deliberation that has been done has been done with the premise of piracy,rather than the utility involved - wich is neither described in DMCA,Copyright Law,or the Electronic Theft Act,as to the esthetic available to authors,or person of use the piracy relationship is what is denoted. This in place of the rational usage wich in fact is contributive to copyrighted materials .As there performance is esthetic no matter the machinery or relationship involved when there is a person of use.
Authors as well are not aware that the new facets involving digital publications can be,and legally debated they belong to the new concepts as royalties different in effect of previous conditions of contract. Since they are 'new esthetics to the works involved.
I'm mentioning this because the fashion to fatalize the utility for digital relationships using the 'premise of piracy misses a distinguishing point of control,and feature involved in copyrighted works.
And to conclude,I must share that the usage of 'liscencing in and of itself is a business conception. Copyright,DMCA,and No Electronic Theft act,does not give inclusion to the rights to create usury through liscencing on the basis of those laws. The utility involved in the defines of 'internet should not be confused as a basis to remove 'persons,either within author,or use of copyrighted materials. Being an exclusivity of 'network,or digital,or computer borne. There is always a person.
Copyright law should be amended in the U.S. where the institutional inset is set:
- rational fair use to the person of use for the esthetic performance of the copyrighted work.
DMCA should be amended:
-copyfriendly products cannot be prohibited.
When I look at this. I am not talking about the royalty aspect for what is bound in the term of digital. But the value-in-value that can be provided within digital works. To persons using them,as well as bound by authors that produce them.
Explicit copy,Explicit communication,Explicit Performance,storage,and destination.
In any previous generation of effect within copyrighted works nothing has been afforded wich could accomadate such viability to works. Being aware of this,in place of being taken advantage of for both authors,persons,and law makers is something that need to be considered.Again,copyright is explicit to authors,and authors only.DMCA is explicit to its security - and does not denie feature or author. And No electronic theft sets a monetary value to the term of piracy.
It is however the concern to recognize these esthetics,and the reality there is person beyond the written laws known today.And security should not be traded between them as effect,affect or condition.
