Dan Casey voice of reason
On December 17th in Oregon, the National Labor Relations board, ruled in a way that I think kicked what Dan Casey is quoted on off. Basically Web 2.0 is treated like telephones. Employers can't enforce policy that prevents employees from using company phones as long as that does not impact performance. The same was applied in Oregon to email. IM chat would be the same by the voice of reason.

The Bush administration has already established the notion that laws and mechanisms long figured out for telephony apply to digital communications such as email, IM, blogging etc. They did that in addressing Internet Bullies when it was decided that special laws for communication by Web 2.0 means were not needed because the telephony laws already applied. I thought the matter settled then but alas, the word has not gotten out.

But... we also have to note that Microsoft already has multiple email systems and with the Yahoo purchase pending will have even more. The consolidation hence can be viewed as a mechanism solving this problem without any new laws or enforcement of telephony laws.

The voice of reason rules.
