That's what discovery is all about
SCO will have to show their case to IBM during the discovery phase, just like everyone else has had to do in these court battles. IBM doesn't have to resort to anything but holding out their hand to achieve that and can't really get any info from third parties that will be any more revealing. IBM needs to settle this case quickly.
