Yes, it was 17. Don't take my memory here to the bank, but it goes something like this: In the process of harmonizing U.S. patent law to the others of the trilateral (Europe and Japan), the U.S. switched from 17 years from grant to 20 years from application. This stuff all swirled around for a few years, through the failure of the PreGrant Publication Project (PGPub), but I just found this

So I think it settled in at 20 years from application.

I can't follow your agrument on the courts. If the invention is not shown to be revealed in prior art or obvious in light of prior art, or not useful (obviously that would not apply), and the patent holder paid all requisite fees, what basis would a court have for declaring a patent invalid? Courts are established to interpret law when necessary, but not to write laws.
