Ibm admits they contributed code

SCO argues by definition, that contribution violates the contract they have with IBM.

To support thier def of the contract they point out...

Liu v. Price Waterhouse LLP, 302 F.3d 749 (7th Cir. 2002),

Liu demonstrates that contractual language requiring the return of all the source code of a derivative
program is a sufficient basis for a jury to infer that the contract grants the full copyright in the
derivative work to the owner of the original work.

Liu is very different than thier contract but still... will it be enough to get it to a jury.

In the meantime, they say we need more info because if the jury decides our interpretation of the contract is correct, we need to be able to show exactly how IBM is non-literally infringing by contributing thier own home grown code or at least to show the extent which would likely factor in damages.

Can IBM contribute code that IBM writes to Linux (in light of their SysV license). That is the question. There is no question about proof of whether they have. IBM admits it.

What confuses me is why IBM can't but SCO says HP and SUN are clear without seeing any code. IBM raised that point. Why do they need to see our code to show we have when they say other companies haven't violated thier license without seeing that code.
