Funny you should mention UNIX. Both a California state judge and a Federal judge in the 80's told AT&T/Bell Labs to forget about exclusive ownership of *NIX because students and faculty at the University of California had contributed so much code (like multi-drive disc controller system-level drivers, for one prominent example) that nobody could claim exclusive IP on the entire OS. Which is why FreeBSD is allowed.
