Why is that a surprise?
They never intended to obey it. They have never obeyed any consent decree they have ever signed.

Actually it is debatable if they have obeyed any agreement that they have ever signed. The software landscape is littered with the corpses of those foolhardy companies that had enough hubris to dine with the devil.
