Spyware Analogies
Spyware is analogous to someone breaking and entering, and placing cameras and audio recording devices within your home or place of business. I am sure that the judge that stayed this in Utah, if he found that someone had "bugged" his chambers, would have had that person prosecuted. I believe that surveillance (spyware) of private property (computer) without a warrant or consent is illegal in this country. SPYWARE is a felony, and the sooner that the technology challenged judicial system understands this, the better we will all be.

On a related note: Is is not time that this stupid idea called the Registry be eliminated? This horrendously complex, totally superfluous bit of Windows makes fertile ground for Spyware, and restricts the user from many activities that, historically, we easy (like moving a program from one directory or disk to another, and still having it work!) Neither my OSX or LINUX machines have these problems, however, my Windows boxes are a maintenance nightmare.
