"Is it wrong for Hatch to enforce the law?"

This has nothing to do with the law. Big industry is buying government into spending taxpayer money to clamp down on free trade. Everyday people will be spending their own money to try themselves. This is a new kind of indignation being thrust on the public. Who knows how long it'll be before things take a very dramatic turn..

"One of the foundations of democracy.."

Its foundation has yet to be built. America has yet to prove itself to be a democracy; just because we don't publicly behead people doesn't make this place free. This is yet another step in the direction opposite from a real democracy. Did us "important" citizens get a vote on this pro-consumer bill?

"prosecution is handled by an unbiased government entity"

I think bias is too obvious in many of these recent types of cases. 'Unbiased' and 'government' go together like peanut butter and ketchup. Governments will always be biased towards the green$$$.

"Is it okay to pirate music but not software?"

Are the companies making these products that are supposedly being ripped off whining about the fate of your livelihood in dreary internet forums?

"When is it okay to steal?"

Nothing has been stolen. Get an education.

"A number of years ago, the U.S. Supreme Court dealt with a man named Dowling, who sold "pirated" Elvis Presley recordings, and was prosecuted for the Interstate Transportation of Stolen Property. The Supremes did not condone his actions, but did make it clear that it was not "theft" -- but technically "infringement" of the copyright of the Presley estate, and therefore copyright law, and not anti-theft statutes, had to be invoked.

So "copying" is not "stealing" but can be "infringing."

So then they can't deny the way in which we "protect" ourselves.
