So what if it is?
"So, MS has no real interest in buying SAP, simply treating one of the largest ISV's in the world as a pawn in its gambit to move up the corporate IT food chain."

Microsoft may or may not have plans to move into the market; but why is that a problem? Nothing in any of the discussions indicates that Microsoft is using any kind of illegal actions to attempt to move into the enterprise apps business. A merger with SAP would be perfectly legal, since Microsoft doesn't already have a presence in the market. Are you saying that even the consideration by Microsoft of a buyout of SAP is illegal or unethical?

"And they move away why? Because they realize it would force them to become DB neutral or lose more in customer good will than they gain in revenue and app intrinsic value."

There's no indication (other than conjecture) that the necessity of supporting rival databases was the reason for Microsoft's decision regarding SAP; and even if it was, so what? Can't Microsoft decide NOT to enter a market if it wants? Microsoft decides that the loss of customer good will is more important that revenue gain, and that's a BAD thing?

"If the gov's contention was correct, MS would not give a hoost about this potential Peoplesoft/Oracle consolidation."

Was it Microsoft that complained to the DOJ about Oracle merging with PeopleSoft?

Why is there a problem with any of this?
