You're generally right, as long as you don't profit from it. The article indicates that the image was used in an ad.

If you used it in an ad, then you are benefitting from it financially.

However, the article addresses a different issue which the courts ruled on: If a 3rd party creates content (the ad) and you run it on your site, then you are not liable for the actions of the 3rd party that created/placed the ad.
