If you are going to use the code then you must abide by the terms of the license.

I completely understand the SFLC's position. There must be a penalty for violating the license. Otherwise it turns into a game of using the code in violation of the license until you get caught with no real downside.

Had this been involving another company's proprietary code, we would have seen the BSA along with their government thugs breaking down their door.
