I will concede that a good portion of spyware is installed without a users permission via IE or other Windows "features," (more on this later) but the vast majority of spyware comes bundled with other apps. How exactly is that a design flaw within Windows, and how could MS prevent their installation if they are literally being installed by an end user in much the same way they install any other program?

Also regarding the Windows and IE exploits, Spyware doesn't just propogate and spread itself without any user intervention like some of the recent worms, it requires the user to visit a website that has the spyware load with the rest of the page. So, if you don't visit those sites, you don't get the spyware, end of story. Most courts have also ruled that as with pop-ups, visiting a site constitutes consent to have the associated data and applets installed and run on your machine. The new federal legislation requires that a site warn you before doing this, but at least a portion of the blame must fall on the user.

Is the source of this problem not with the people writing the spyware and the companies bundling it with their apps?
