I'm not a lawyer or judge so I can't speak for the constitutionality of the law.
Best solution: have Microsoft fix Windows and IE so that this simply can't happen. That they allowed it to happen in the first place is a major design snafu. That they allow it to continue speaks poorly about them as a company (as if that were really needed).
