problem with the internet as a system as it is is fact that there isn't a person in respect of 'oneself 'whole to the machine they use. The IP,IP addresses as well are contradictory in terms of usage because the concept allows for 'radom control of what that person may mean.
The story is different for static addresses or web domains for example. I you have your own web domain,and spyware is being installed on that 'machine,you could exactly identify yourself with the mention and means of person being violated.
A large percentage of 'business available software in the 'terms of use column,are benifiting from the fact there is not a 'person considered at the relationship of information pertaining to them,and machine operability.
If it was explicit that 'no spyware,could be flagged,as a result of 'onboard survelence AND policy for the machine in-its-person, then the software regardless of agreement in apendage of software instalation could actually 'machanically install spyware. It is the ideal situation to simply install what you want,and ask the questions later of the necesity of the non-essentiallity of trading privacy,for program functionality.
It should not be a trade for operable software. Demographic information,web surfing habits,shopping habits - things like this. They add up on a total group of persons who if they were in fact individual,and someone explained to them that 'they did not know that they did not have to trade in lieu of program interoperabity.
The fact of the internet as it is being an easy score to that point.Things should be the other way around in every facet.Monitor software is simply not an option for interoperability. Privacy is not available for trade of functionality.
You will find that a lot of fully functional software does not require the additive of 'advertisement AS A CONCEPT to be completely performance enhanced. The quantifying of habits is actually a dogma of usury,and agent of tender in wich illicit different practices - that are not so acceptable.
Your looking at different precepts when it is said a spyware is for 'advertisement ehhancements. You might have said in the same term that you would receive,or a person would receive advertisement. But just how this means that because of this as well,in addition to that advertisement - they would be 'monitored in return for performing functional software ?
There are alternatives. It is difficult to turn them down when you do read those agreements. But sad part is that the functionality of the programs themselves is considered a tradable asset for your privacy. Privacy you didn't know you could find,and is so difficult to describe using the present day illusive concepts currently delved as everyday practice.
Things can change but the risk is where business starts it. That is what I mean by being an easy target - just the way things are defined in 'person,and machine. Business is great and people are ignorant of it.
You could for example 'sue a company installing spyware on your machine. From an individual standpoint. Defining you,yourself,from what the agreements take in kind may take some defining in and of itself. Since it would be rather simple to add the perspective,it will take business to refine them.
And there is business on both sides.
