Unconstitutional?
The judge granted the injunction on the grounds that the Spyware Control Act is "unconstitutional"?

I don't know how any company can claim a Constitutional right which allows them to secretly install an executable onto anyone's system which collects information about them and then reports back.

In general government should stay away from the net but on the other hand no one should be installing anything on any of my systems without my expressed permission.

To me secretly installing spyware on a person's comptuer is no different than breaking into someone's home and installing hidden cameras which stream video to an unknown entity.

I support such a law providing it allows for spyware on an opt-in basis only.
