Stealth Patents!
If a patent owner allows the technology allegedly covered by their patent to become an industry standard (downloading .dat files, software patches/updates, etc.) and does not enforce their patent from the beginning, they should be denied the right to later attempt to enforce the patent when their technology has become ingrained and indispensable. Stealth patents are far more evil than patented technology licensed from the start - look to those types of patents when decrying that patents stifle software innovation.

A perfect example was the failed attempt to extort the Internet population by trying to claim/enforce a patent on URLs. (BT was it?)
