So let me get this straight, if something that Comapny invents becomes commonplace the patent can be revoked because of third party protest. Now to me this is unfair for any company regardless of market position.

here is the real issue not fairness

"Some have worried that Microsoft may claim that Linux infringes on Microsoft patents and will seek a royalty. Any monetary compensation could threaten the operating system, which under the terms of the General Public License (GPL) may not be distributed if it contains patented technology that requires royalty payments."

They dont want to pay for royalties. Now isn't this unfair. I m not concern about MS or Linux, because it is not about that. If you use simple logic or lets say your head you will see how this undermines patents and the protection they provide for created works and the revenue from those created works.

This is unfair for any company . Whether a Linux or not. I hope this reexamination gets tossed because it is a waste of taxpayer dollars. Not to mention that if the patent gets invalidated than reimburse MS or any company for that matter for going through the patent process
