Not really unexpected.....
Actually Novell had the trial moved to Federal jurisdiction and SCOX wanted it moved back to state court so that they could prosecute Novell on a contract issue rather than get involved in a copyright case. Since they claimed that the copyrights were transferred to them by the agreement that the judge said did not clearly transfer anything at all, much less the specific copyrights that they claim that Novell doesn't own anymore they are now pretty much hosed. And they did it to themselves by invoking an issue that is only resolvable under Frderal jurisdiction. That's the most satisfying part......

I was a little surprised that the judge allowed SCO to delay even further given that they aren't even trying to make it look like they are acting in good faith anymore. It may simply be pragmatism: They have no case, so delaying a trial that's never going to happen does no real harm to IBM and prevents SCO from appealing on that basis. All in all a good day for justice and a very bad day for SCO. Or am I repeating myself here?
