IANAL, but SCO's suit has not been dismissed. The exact wording is Defendent's Motion to Dismiss is DENIED as to Plaintiff's pleading of falsity and GRANTED as to Plaintiff's pleading of special damages.

SCO is allowed to pursue the claim of slander of ownership, but the judge has tipped his hand that the evidence of transfer of ownership is not compelling. SCO is still alive on this one but will have to do weave a mighty fancy story to convince the judge that it owns the Unix copyrights (the last sentence you posted).
