The judge did refuse Novell's motion for immediate dismissal, meaning copyright ownership cannot be decided outright, but that the transfer douments must be more closely examined.

Try again. The Court dismissed the suit. Dismissed.

The Court also stated that it was too early to rule on the issue of a 204(a) assignment, but dropped some pretty heavy hints that otherwise he'd have found for Novell on the merits as well.
