Technically

Xandros cannot charge for GNU/Linux or the OSS apps technically. What they will tell you is that they are charging for commercial apps/utilities, support, and the cost of reproducing the media and distribution. They provide access to source to those they "distribute" to. In a way they are getting around the letter of GPL. Lindows operates the same way.

Why anyone would bother with these crippled, half functional distros is beyond me when it is very easy to get more capable, fully functional distros as easily. They seem to think they are making it easier for Win users but the latest from Mandrake, SuSE, and Fedora can't get much easier to install and work with.
