I still don't understands how they get away with it

Can someone please enlighten me with this. How does company like this or Red Hat get away from NOT providing ANY Linux software regardless of versions as a freely available downloads ? I understands the agrument about some of these might contain some form of 'Closed Source' software. But still, say, shouldn't they be REQUIRED to distribute everything up-to these closed source software ? Which includes all the API's that are required to communicate to these 'Closed Source' application so that someone can go out and 'write' an OSS app that can take over these 'Closed Source' app ???
