What do you expect...
When a company is accused of patent infringement they have only two courses of action:
1. Acknowledge the violation and agree to a settlement.
2. Try to have the patent invalidated.

Over the past several months MS has taken the first course in a several different cases. The links below point to a couple of cases:

http://www.technewsworld.com/story/32479.html
http://dba-oracle.com/oracle_news/2004_4_26_rittman.htm

In this case, however, they have chosen to fight. They have every right to do this if they think the patent is invalid. In this particular case a number of MS adversaries are actually on their side.

There is no hypocrisy involved in this. They have the right to defend their valid patents while trying to invalidate someone else's patent. The courts need to sort out the details and determine who is right. This is not crying, whining or complaining. It's business.

And, by the way, I believe that ALL software patents should be invalidated. I think software should be covered by copyright law only. You shouldn't be able to copy someone's code, but you should be able to write your own code that accomplishes the same function.
