Actually, it IS the examiner's job
To conduct the prior art search. This is why patents and patent applications are classified and examiners are assigned to art units - to allow the "experts" to examine the claims in light of prior art. The problem, as I posted above, is that there is precious little time alloted for the examnation, so the search is cursory.

In some technology areas (some of the mechanical), the art is relatively stable and the examiners become pretty proficient. In others, such as biotech, there are automated search tools. In software, chaos reigns. Any time you are curious, pull a software patent. Odds are high that you will recognize the "invention" as something you have used or seen before. Just randomly, I have yet to pull a software patent that disclosed anything unique.
