Microsoft NOT convicted of being a monopoly
You and a lot of other posters to these forums seem that think that MS was convicted of being a monopolist. Since there is no law against being a monopoly, per se, then one cannot be convicted of being a monopoly. The court ruled that they are a monopoly and convicted them of abuse of monopoly power.

The DOJ cannot break up a monopoly simply because they are a monopoly. Breakup is used only when antitrust laws (such as abuse of monopoly power) have been broken AND the courts feel that breakup is the only way to remove the abuse and enable competition.

For whatever reason, the appeals courts felt that breakup was not warranted in the MS case.

By the way, most people forget that a few years back the DOJ did step in and prevent MS from buying Intuit. In that case they felt that the acquisition would have been anticompetitive in the financial software market.
