You've finally made some interesting points
Judges in general are not out to win any popularity contests, they are there to leave their personal opinions out of their legal decisions. The decisions are made by them based on facts and these facts are explored in detail with consideration given to anything these facts lead to. Much like giving blood, if a donor donates tainted blood, it shouldn't be left to the blood bank to pass it on without screening it for virus or infectious diseases. This did happen and it took similar court actions to get a legal decision that prompted our law makers to implement new laws to govern this issue. This too is a new issue and one that needs to be decided on by the courts and not Microsoft.
