It never fails to amaze me how you simplify things
If this kind of decision was so simple as you make it out to be, it wouldn't take this long to reach a decision but then this decision is not being made in the U.S. for a U.S. Company like Microsoft. It would surprise me if they handled this in the same way as they did in the US appeals court because the legal system works a little differently over there. The court will likely give it's decision based on each and every item that they investigated in detail to determine a ruling based on the facts not somebody's wish list.
