As far as MS and the EC, all is going as it should. By that I mean the EC has made their claim and now the law (courts) will be applied to determine the outcome. At that time both sides will regroup and decide where each side wants to go with it. (Obviously the loser will seek an appeal.)

This is as laid out by EU law and falls within the original estimates of how long the case would take. In other words, there has been no "misdoings" by anyone.

On a purely personal level and with my current understanding of the case and EU law, I believe fully that the EC over reached both their cause and with their remedies. Certainly removing the Windows Media Player turned out to be completely ineffective, and frankly, was laughed about around the world.

Futher, I don't believe the courts will ignore the user as the EC has done. The Media Player fiasco, the lack of complaint from users, the wide acceptance of the product Windows, and the investments by ISVs in Europe that have built on the ecosystem provided by Microsft are all things they will be looking at.

As I see it the balance comes out like this.

Law + User Benefit vs. MS competitors + EC


In fact, it would not surprise me at all to see the court do the same as the US appeals court and ask the EC to provide a case based on user "Harm vs. Benefit". If so, its all over...
