Details notwithstanding, this could be HUGE!
First of all, with respect to IP, most of Solaris was developed by Sun, it's thier IP to do with what they choose. Any legacy code would be omitted from the release, even if it rendered the OS inoperable. They can still give away the legacy binaries for customer use even if their customers can't modify it or redistribute it.

But wait. Solaris is the most widely used UNIX in the world. Huge install base, huge knowledge base, and potentially a huge developer base. If they released only a partial system, the missing pieces could be redeveloped by an open source project in a matter of months, if not less.

Linux is putting pressure on the Solaris revenue stream, so why not open it up anyway. Then, customers who already run Solaris and love it (of which there are many) will reconsider migration to Linux and likely stay with Solaris.

Let's face it. It's the kickassin'est OS on the planet!

And what's the best hardware on which to run Solaris?
