Yes, Baystar realized they were screwed.
Better to get out while the getting is good. It also would be a big distraction, and next to imposible to try and control SCO. Better to get what you can and wash your hands of it. They can just hope they might get something for the remaining shares. If the share prices get low enough, IBM or somebody else might just buy SCO out and put the code in the public domain to end this once and for all.
