The Linux developers could make changes, but the source code is there for all to read, so they could never claim it never happened.

To prove it in court Microsoft will have to show the code that they claim infringes (in which case the Linux developers will simply accept the facts and change their code), until Microsoft show the code it's hot air, and nothing infringes. If they won't or can't it's racketeering. The only way Microsoft can make money out of these alleged infringements is with stand over tactics reminiscent of the Mob, an that is precisely what they are trying to do.

No that's the best way to be controlled by Microsoft, as indeed are Linspire and Xandros and to some extent Novell.

They are in excellent company, it seems, Red Hat and Cannonical also turned down Microsoft's offer they couldn't refuse.
