No, "counterproductive for the industry as a whole" even includes Microsoft, which is also a potential target for a few (thousand) patent infringement claims - most with vastly more validity than the extortion racket they're peddling now.

If this is an example of the logic and lucidity of your defense, Microsoft should demand that you change your screen-name to "defcondon'tbother".
