"Linux software did not come from Microsoft's code base."

There is no claim that Linux software came from an MS code base.

The claim is that Linux code infringes on patents that the U.S. government granted to MS. This can be possible even if the Linux dev came up with the ideas completely on his own, it doesn't matter.
