Specifics vs generalities
If I give a specific example, the example can be debated. This part of my argument can be accepted if you agree only that it is possible for "Linux, Inc." to be sued.

It's the same approach you see in the Perens discussion when he said:
We must do something so that there is reason for people to innovate, there is reason for people to invent, but that companies can execute without this constant fear that we will be sued into the ground regarding software patenting.

One interesting part of this to me is that he referred to small and medium companies as being like open source, part of the "we" in this quote. He has already come to think of open source as a sort of corporation.
That's different from thinking of it as a loose community which is not a legal entity.
