Alcatel could afford to match lawyers, FSF can not.

But putting that aside, if the FSF tries to claim tht all distros have the same rights that Novell has you can fully expect to see MS going to court to have the GPL-3 tossed out as exclusionary.

Keep in mind, they need not sue anyone, all they need to do is ask the court to rule on the GPL-3. As no one would be sued the only way anyone (FSF?) can even participate in the suit is to file "friend of the court" breifs.
