Too Soon To Worry
Until Linus accepts GPL3'd code into Linux, I don't think there is much to worry about. Existing code can still be maintained at the GPL2 level and there's nothing to prevent new code under GPL2, even after GPL3 is in the wild.

How the take-up of GPL3 proceeds, and what the ultimate legalities become, won't be clear overnight. I think that Novell should be cautious, as they seem to be in their filing, and it is appropriate for them to put a cautionary note in that material. That is not the same as saying GPL3 will actually derail the deal.
