- It matters not what IBM desires....

That has nothing what so ever to do with the case at hand.
SCO attacked, and there for (regardless of IBM ultimate desire/plan) IBM has the moral high ground in this particular battle..by simply defending itself.
Everything and I do mean everything revolves around what SCO can or is willing to prove. Since SCO has been unwilling or unable to produce anything...Well then IBM is correct in asking for this dismisal. Why continue to fight a battle that the other side started and refuses to put up or shut up?
Also if the judge decides to dismiss the SCO case SCO should be made to pay for IBM's costs in this case..as well as Redhat and Novell and any others including AutoZone.
