This is dealing with SCO, remember?
This is the same SCO that publicly accused Linux of harboring hundreds of thousands of purloined lines of code, next actually filed suit against IBM, then told the court it would be unable to identify that code without every line of every version of AIX.

The FSF has openly published this supoena and has made the following observation

Late last year, we were subpoenaed by SCO as part of the ongoing dispute between SCO and IBM. Today, we made that subpoena available on our website. This is a broad subpoena that effectively asks for every single document about the GPL and enforcement of the GPL since 1999. They also demand every document and email that we have exchanged with Linus Torvalds, IBM, and other players in the community. In many cases, they are asking for information that is confidential communication between us and our lawyers, or between us and our contributors.

Lacking insights into the nature of the information in question, in advance of negotiation, and possibly like in the IBM case necessary intervention on the part of the judge, it is a bit gratuitous of us to ridicule a position of which we have no knowledge. FSF is being very up front about this matter, so there is little point in jumping to the conclusion that it will be other than open in responding.
