"Forced expenses"?
You stated "It is really sad to see a company use the court system to try to force expences on other companies." I have no idea if SCO has a legitimate case against IBM or not, but assuming they do, they are not "forcing expenses" on other companies - they are protecting their rights under the intellectual property laws of the United States.

It is amazing how everything that is "against" open source is somehow evil and unfair and everything that is "for" open source is good and right and wonderful. It is great that open source development can accomplish all that it has, but if the contributors to open source illegally violate the intellectual property rights of other companies, someone has to be held liable.

If you owned copyrights to code that you discovered were copied in an open source project, wouldn't you "use the court system" to correct the problem if you had to?
