It is a fair portrayal of the way things likely are except that Brad Smith isn't portrayed as the American traitor that he really is. I mean there is no mention of his studies in Europe or the significant about of European work he did for Microsoft when Neukom was in charge and he was Neukom's EU counterpart. Smith instead is a "Prinston man" - oh brother.

I really have come to believe that Smith's objective is to loot Microsoft of as much as he can in ways that benefit his barrister EU cronies and his EU based personal bank accounts. He has no intention of ever settling with the EC because the longer the case goes on the more pay back to those who helped his career when he worked in Europe. The more fines levied the more pay back. The longer it goes on the more potential to find positions for his friends and himself post Microsoft. He doesn't care about Microsoft as a going concern or the good name of the brand. He cares nothing for the employees, or the State of Washington or the American IT industry or the USA. It is all about his personal legal (not software) career and retirement someplace in Europe. It is about the Smith Impact - so ironic Smith when you think of taking the pink pill and falling out of the matrix.

On a positive note, patents are always available for use by Americans who do not intend to make money from them but rather use them for personal use or to compare them with other ways of doing the same. And as the article mentions, mathematics, the binary files themselves, is by agreement or law not patentable. I think that kind of blows the legal arguments out of this. It also explains why Microsoft will only patch its operating system products with binary files. Smith has so turned Microsoft into a legal firm that it is now the SO STUPID ONE. Let Microsoft identify the patent infringements. Remove the source, still distribute the binary and it is all over but for the fat bald guy to sing.
