If I read the article right, the fines that are paid go to the government. If Microsoft wants anything they have to sue the ISP or company or whoever and then if they win, the money they get do not come out of the fine paid to the government but whatever they get from the pirates. The amount that MS wins may or may not be much higher than the fine paid to the government.
