That the material has been around a lot longer than the Internet, I don't think the war is being won. Like drugs, slavery and other things that stink, we have not been able to legislate it out of existance. The Internet is not the primary source of the material. There are nasty little corners of the world where the production is done the old-fashioned way (darkroom, video cameras, mail distribution and swapping) and killing the P2P connection won't stop it.

It amazes me that you are fixated on the P2P aspect, as well, when there are dozens of other Internet-based distro methods not being addressed. As for the RIAA angle:
