The users of SpamCop - 'Opted-in to using the service. They where probably aware of the relationship(s) they where to encounter as far as the 'inboxes they pertained to.

While the email advertiser is as well aware of the relationship of its email send outs. It certainly may not have been aware of these relationships as they pertain to 'inboxes.

The email would not be at question. Howebeit only the receipient would argue in favor of or against delegations for the 'inboxes they control.
